End User License Agreement (EULA)

Agreement Overview

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Fist Bump Labs, Inc. ("Licensor"), a Wisconsin corporation, governing your use of the Fist Bump Scores software application ("Software"), including the mobile app, progressive web app, and any related updates, features, and documentation.

By creating an account, installing, or using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.

This EULA is incorporated into and should be read alongside our Terms of Service and Privacy Policy, which also govern your use of the Software.

License Grant

Subject to your compliance with this EULA and payment of any applicable subscription fees, Fist Bump Labs grants you a limited, non-exclusive, non-transferable, revocable license to:

Ownership & Intellectual Property

The Software, including all copies and derivative works, is and remains the exclusive property of Fist Bump Labs, Inc. This EULA grants you a license to use the Software; it does not transfer any ownership interest. All rights not expressly granted are reserved by Fist Bump Labs.

The Software contains proprietary algorithms, data structures, user interface designs, and business logic that constitute trade secrets of Fist Bump Labs, Inc. You acknowledge these constitute valuable confidential information and agree to maintain their confidentiality.

Subscription & Payment

Certain features of the Software require a paid subscription. Payments may be processed by Stripe, Inc. (for web purchases) or through Apple App Store / Google Play Store (for in-app purchases). By subscribing, you authorize recurring charges according to your chosen plan:

Your subscription renews automatically unless canceled before the renewal date. Fist Bump Labs does not store your payment credentials — all billing data is managed by Stripe or your device's app store under their respective PCI-compliant infrastructure.

Golf Scoring & Handicap Disclaimer

Recreational Use Only: The scoring and handicap tracking features of Fist Bump Scores are designed for recreational and informal use among friends and golf groups. They are NOT certified, endorsed by, or affiliated with the United States Golf Association (USGA), the R&A, or the World Handicap System (WHS).

Handicap index values calculated by the Software are approximations based on entered scores and simplified formulas. These values:

Not a Gambling Application

Fist Bump Scores is a golf scoring and game tracking application. It is not a gambling application, and Fist Bump Labs, Inc. does not facilitate, promote, or enable gambling of any kind.

The Software displays the results of golf games and side game calculations entered by users. Specifically:

By using the Software, you acknowledge and agree that Fist Bump Scores is a golf game result display tool, not a gambling service, and that you are solely responsible for ensuring that any informal financial arrangements made between you and other players comply with all applicable local, state, and federal laws.

Updates & Modifications

Fist Bump Labs may release updates, patches, or new versions of the Software at any time. Updates may add, modify, or remove features. Your continued use of the Software after an update constitutes acceptance of the updated Software.

We reserve the right to modify, suspend, or discontinue any feature or the Software itself with reasonable notice. We are not liable for any modification, suspension, or discontinuation of the Software.

Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination:

Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FIST BUMP LABS DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME ALL RISK ASSOCIATED WITH THE USE OF THE SOFTWARE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FIST BUMP LABS, INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE SOFTWARE, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL.

FIST BUMP LABS' TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM OR $100.

Governing Law

This EULA is governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any disputes arising under this EULA shall be resolved exclusively in the state or federal courts located in Rock County, Wisconsin.
