Acceptance of Terms

These Terms of Service ("Terms") are a legal agreement between you and Fist Bump Labs, Inc. ("Fist Bump Labs," "we," "us," or "our"), a Wisconsin corporation, governing your access to and use of the Fist Bump Scores mobile and web application ("Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Description of Service

Fist Bump Scores is a golf scoring and management platform that provides:

• Round-by-round score tracking and stat analysis
• Side game management tools (Skins, Wolf, Nassau, Stableford, Best Ball, Skills, Team Sixer) with automated settlement calculations
• League management including standings, dues tracking, and season money lists
• Tournament event hosting with multiple formats, live leaderboards, and TV display mode
• Handicap index tracking (for recreational reference; see Disclaimer below)
• Personal journey stats, achievements, and course mapping
• AI-powered scorecard scanning
• SMS and push notifications (opt-in only)

Account Registration

To use the Service, you must create an account using a valid email address and password, or through a supported sign-in method. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials confidential
• Notify us immediately of any unauthorized access at contactus@fistbumpscores.com
• Be responsible for all activity that occurs under your account

You must be at least 13 years old to create an account. By registering, you represent that you meet this age requirement.

Subscription Plans & Billing

Free Tier

The Free tier provides limited scoring functionality at no charge. Features are subject to change.

Pro Subscription

Pro is available at $4.99/month or $39.99/year (billed in advance). Pro unlocks advanced scoring features, stats, side games, achievements, and more.

League Tier

League management is billed at $8.00 per player per season, charged to the league commissioner at the time of league creation or renewal.

Tournament Tier

Tournament events are billed at $2.00 per registered player per event, charged to the tournament organizer at the time of event creation.

Payment Processing

All payments are processed by Stripe, Inc. By providing payment information, you agree to Stripe's terms of service. Fist Bump Labs does not store your credit card or bank account numbers.

Refund Policy

Subscriptions are generally non-refundable. We may, at our sole discretion, issue refunds in cases of billing errors or extraordinary circumstances. Contact us at contactus@fistbumpscores.com within 14 days of a charge if you believe you were billed in error. Tournament and league fees are non-refundable once an event or season has commenced.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period and you will retain access to paid features until that date.

Price Changes

We reserve the right to change pricing with at least 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Financial Calculations Disclaimer

The side game settlement, prize fund, pot management, and payout calculation features of the Service are provided solely as mathematical calculation tools to help groups organize friendly wagers among themselves. Specifically:

• We do not collect, hold, transfer, disburse, or custody any money on behalf of users
• We do not facilitate peer-to-peer money transfers
• All actual exchange of money between players is solely between those players, using their own chosen methods (cash, Venmo, PayPal, etc.)
• Settlement figures shown in the app are calculations only — they are not guaranteed to be accurate for every course, rule variation, or game setup

By using the side game and settlement features, you acknowledge that Fist Bump Scores provides calculations for informational and organizational purposes only, and that you are solely responsible for verifying amounts and for any actual money exchanged with other players.

Users should be aware of and comply with all applicable local, state, and federal laws regarding wagering and gaming. Fist Bump Labs makes no representation regarding the legality of any wager in any jurisdiction.

User Content

You retain ownership of all scores, stats, photos, and other content you submit to the Service ("User Content"). By submitting User Content, you grant Fist Bump Labs a worldwide, royalty-free, non-exclusive license to store, display, and process your User Content solely to provide and improve the Service.

You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable law.

We reserve the right to remove User Content that violates these Terms or our Acceptable Use Policy.

Commissioner & Organizer Responsibilities

If you create or administer a league or tournament ("Commissioner" or "Organizer"), you are solely responsible for:

• The accuracy of player information, scores, and game settings you configure
• Communicating rules, buy-in amounts, and payout structures to participants
• The actual collection and distribution of any money among participants
• Ensuring all participants are aware of and agree to the rules of your league or tournament
• Compliance with applicable laws regarding wagering or gaming in your jurisdiction

Fist Bump Labs is not responsible for disputes between players, incorrect settlements, or any money-related outcomes arising from the use of the Service.

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law
• Submit false or misleading information (including falsified scores)
• Attempt to gain unauthorized access to any account, system, or network
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated bots, scrapers, or scripts to access or extract data from the Service
• Harass, abuse, or harm other users
• Use the Service to conduct, facilitate, or promote illegal gambling
• Resell, sublicense, or commercially exploit the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms.

Intellectual Property

All content, features, and functionality of the Service — including the software, design, text, graphics, logos, icons, and data compilations — are owned by or licensed to Fist Bump Labs, Inc. and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes, subject to these Terms. No other rights are granted.

"Fist Bump Scores," "Fist Bump Labs," and related logos are trademarks of Fist Bump Labs, Inc. You may not use them without prior written permission.

Third-Party Services

The Service integrates with third-party providers including Google Firebase (data storage and authentication), Stripe (payment processing), Twilio (SMS delivery), and Resend (transactional email). Your use of these services is also subject to their respective terms and privacy policies. Fist Bump Labs is not responsible for the practices of these third parties.

Disclaimers

Golf Handicap Disclaimer

Fist Bump Scores provides a handicap tracking feature for recreational and organizational reference purposes only. This feature is not affiliated with, endorsed by, or compliant with the United States Golf Association (USGA), the World Handicap System (WHS), or any official golf handicap authority. Handicap figures calculated by the Service are approximations and should not be used for official tournament play or USGA-sanctioned events.

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Accuracy

While we strive for accuracy in calculations and features, we make no guarantee that scoring calculations, settlement figures, handicap estimates, or statistical outputs will be accurate or error-free. You should independently verify any financial amounts before acting on them.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIST BUMP LABS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO FIST BUMP LABS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Fist Bump Labs, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; (d) any money exchanged between you and other players using the Service's calculation tools; or (e) your violation of any applicable law.

Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — shall survive.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 14 days in advance by posting a notice in the app or emailing you. If you continue to use the Service after updated Terms take effect, you accept the new Terms. If you do not agree to the changes, you must stop using the Service and may cancel your subscription.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Rock County, Wisconsin, and you hereby consent to the personal jurisdiction of those courts.
